Terms & Conditions

Welcome to the emmasomerset.co.uk website terms and conditions for use. By using this website you agree to these terms and conditions. If you do not agree to them you may not use this website and should leave it immediately. These terms and conditions may be updated from time to time. This website can not be used for any commercial purpose.

Presentation of Products

We take great care presenting the merchandise on our website as accurately as possible. However your monitor’s display and colour capabilities will affect the image you see. We therefore can not guarantee that the image you see is an accurate representation of the actual product.

Description of Products

We take reasonable care to ensure that all information on the website, including details, descriptions and prices of products are correct at the time it is entered onto the system. We aim to continually update this information, however the details, descriptions and prices etc. may not reflect the position at the exact moment you place your order. Product information and prices will not be verified until your order has been accepted in accordance with our Order Acceptance Policy.

Order Acceptance Policy

When you place an order to purchase items either using our website or by telephone, this is an offer by you to us to purchase those goods. Emma Somerset’s acceptance of your order only takes place when your order is dispatched, unless you have cancelled your order in accordance with our Order Cancellation Policy. Receipt of your credit card details and debit of payments does not constitute our acceptance of your order. Any payments made for unaccepted orders will be fully refunded.

Non-acceptance of an order can occur for a number of reasons. For example:

  • The product you ordered is out of stock.
  • Being unable to obtain authorisation for your payment.
  • A pricing or product description error.

In these cases we will contact you as soon as possible. If we discover an error in the price or description of the product you have ordered you will be given the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we may treat your order as cancelled.

Order Cancellation Policy for On-line Purchases

You can change or cancel your order for any item purchased on-line from Emma Somerset. Notification of order changes or cancellations must be made in writing by letter or e-mail to our Customer Care Department, within 7 days of submitting your order. You will need to quote your order reference number. However, if the item has already been dispatched or delivered to you, you must return the item to us in accordance with our returns policy.

Returns Policy for On-Line Purchases

We hope you will be delighted with your purchase. If however you wish to return your purchase for a full refund or exchange simply post it back to the address below or return it to your local Emma Somerset store. The order must be returned in its original condition* to Emma Somerset within 7 days of receipt with the original delivery note and a completed Returns Form. Full instructions on how to return merchandise to us together with the Returns Form will be included with your order. Unfortunately, we cannot refund or exchange used / worn or customer damaged goods (statutory rights not affected).

Return costs are the customer’s responsibility and will only be reimbursed in the case of damaged, faulty or incorrectly supplied goods. (We ask that you send us copies of postage receipts when returning faulty, damaged or incorrectly supplied goods). Emma Somerset can not be held responsible for any goods that fail to reach us or accept liability for packages damaged during transit back to us. We advise that you use a delivery service that insures you for the value of the goods and recommend that you retain proof of posting. Goods should be packed to prevent damage, reusing the packaging it arrived in. Refunds will be credited by the payment method used to make the original purchase.

*Note: When trying on your purchase please ensure that you are not wearing the likes of perfume, makeup or deodorant that may leave marks or a scent on the item. The logo seal must still be unbroken and attached to the garment. We regret that we will not be able to accept the return of any product where there is evidence that these guidelines have not been followed.

Items that can not be returned

We regret that some items by their nature are non-returnable and we are unable to exchange or offer a refund if you decide you no longer want them. These items include products such as underwear and are marked by a + next to their style code. This however does not affect you rights in terms of faulty or damaged goods.

 


Delivery

We are not responsible for any delay in delivery occurring due to postal delays or any other factor out of our control. Please note that we currently only deliver to countries within Europe.

Deliveries within the UK

There is no charge for deliveries made within the UK. Deliveries within the UK are made by Royal Mail’s Special Delivery service. We aim to deliver your goods within 7 days. No deliveries are made on Saturdays, Sundays or Bank Holidays. When your order has been despatched a 13 digit reference number will be e-mailed to you. You can track your order by logging on to www.royalmail.com and entering your reference number into the Track & Trace box. All deliveries need to be signed for. If you are not at home to receive your delivery a card will be left and your parcel taken to a local Royal Mail Delivery Office. You are then given the option to collect the parcel from the office or arrange for it to be re-delivered at a suitable time.

Deliveries to other European Countries

Deliveries to other European Countries are made by Royal Mail’s International Signed For service at a standard charge of £16.50. Delivery is usually within ten working days but this can not be guaranteed. When your order has been despatched a 13 digit reference number will be e-mailed to you. You can track your order by logging on to www.royalmail.com and entering your reference number into the Track & Trace box. Please note that parcels can only be tracked until they leave the UK. All deliveries need to be signed for.

Prices

Items are invoiced in GBP sterling and we can only accept payment in GBP sterling. Prices displayed on the website include United Kingdom Value Added Tax.

Import Duty

ESFD Ltd cannot be held responsible should local customs authorities charge any import duty or taxes. You are liable to pay any duties and taxes incurred.

The Website

Entering the website is entirely at your own risk. Emma Somerset does not guarantee the material contained in the website or any of the functions of the website will operate without interruption or will be free from defects, viruses or bugs. We will not be held responsible for any indirect, or consequential loss of whatever nature, including damage to software or hardware, loss of data, damage for loss of business or profit arising out of a connection with use of the website.

Our website includes links to third party websites. When you use these links you are leaving our website. We do not control and can not be held responsible for the content of these linked sites, nor do we endorse any of the product / services featured on them. You enter any of the linked third party websites entirely at your own risk.

Under no circumstances are you allowed to publish, distribute or reproduce in any format the content that appears on the emmasomerset.co.uk site.

We at Emma Somerset are committed to protecting your privacy. We only use the information we collect about you lawfully and we fully comply with all applicable UK Data Protection and consumer legislation.

We collect information about you for two reasons. Firstly, to process your order and second, to ensure we are providing you with the best possible customer service. The information we collect includes:
